Blocking Baseless Injunctions
The Resistance 2.0 is in full swing.
The left is trying to stop Donald Trump from doing anything. Seriously, anything, even things the left would agree with. “Orange man bad.”
But, most of their efforts have just crashed and burned.
Massive protests? Only a few people will show up after Trump cut the money to USAID that was being funneled into George Soros run non profits.
Stall Trump's legislation in Congress? Schumer just absolutely caved on the spending bill because he had to. He really didn't have any other option. Mike Johnson and Donald Trump are so far outsmarting Schumer and the Democrats in the Senate.
Bash him on Big Media? People aren't watching and those who are, aren't changing their minds about Trump either way.
So, the only effort of the Resistance 2.0 that's having any effect is the judicial resistance. Leftist activists file lawsuits in courts of Judges who were appointed by Bill Clinton, Barack Obama, or Joe Biden, and those judges, many of whom have obvious conflicts of interest, then issue nationwide injunctions on whatever it is Trump is trying to do.
The Supreme court is going to have to take this up, but that could take a while, and in the mean time, the leftist activists are able to slow Team Trump down a bit.
So, that's why an executive order President Trump signed this week may be the most important one he's signed yet, and that's frankly saying something.
Ensuring the Enforcement of Federal Rule of Civil Procedure 65(c)
Sounds pretty simple. Maybe even boring. It's not. It's a huge game changer.
It says, "In recent weeks, activist organizations fueled by hundreds of millions of dollars in donations and sometimes even Government grants have obtained sweeping injunctions far beyond the scope of relief contemplated by the Federal Rules of Civil Procedure, functionally inserting themselves into the executive policy making process and therefore undermining the democratic process."
That's all true.
"The effective administration of justice in the Federal courts depends on mechanisms that deter frivolous litigation, protect parties from unwarranted costs, and streamline judicial processes. One key mechanism is Federal Rule of Civil Procedure 65(c) (Rule 65(c)), which mandates that a party seeking a preliminary injunction or temporary restraining order (injunction) provide security in an amount that the court considers proper to cover potential costs and damages to the enjoined or restrained party if the injunction is wrongly issued."
Trump’s executive order is mandating that all parts of the government insist upon those securities. Essentially, if you want to force the government to spend $2 billion through USAID, as one lawsuit is insisting, then, you would have to put up a $2 billion security deposit if the nationwide injunction is proven to have been made in error (which it most certainly will be). So, it's no longer just the cost of filing the lawsuit that's at risk. These activist groups would now be on the hook for Billions of dollars, not just thousands of dollars. See how this is a game changer?
He's just raised the ante for judicial poker, and in the process, he's going to take away the only action the Resistance 2.0 has been able to do so far to slow down the Trump Train and thwart the will of the American People.
